Who we are and acceptance
These Terms and Conditions (the “Terms”) govern your use of the TrackFit app (the “App”), made available by Harem Dev (Andrea), who can be reached at info@harem-dev.com.
By signing up and ticking the acceptance box, or by using the App, you confirm that you have read and accepted these Terms and the Privacy Policy. If you do not accept them, you may not use the App.
Eligibility and account
To use the App you must be at least 16 years old and create an account with Google, with Apple (on iOS devices) or with an email and password. You are responsible for keeping your credentials confidential and for everything that happens through your account; if you suspect unauthorised use, write to Harem Dev (Andrea).
The information you provide (for example weight, height, goal) must be accurate and kept up to date by you.
What the App offers
TrackFit lets you create workout plans, log sessions (sets, reps, weights, rest times), view statistics and progress, browse an exercise library and add to your own plans the ones offered in the marketplace.
Marketplace plans are created by Harem Dev (Andrea). The plans and workout data you enter yourself are personal and visible only to you.
Health notice
TrackFit is a tool to log and organise your workouts. It does not provide medical advice, diagnosis or treatment, and is not a substitute for a doctor, physiotherapist or qualified trainer.
Before starting or changing a training programme, especially if you have a health condition, are pregnant or have not exercised for a while, consult a doctor. Physical activity involves risks, including injury: the choice of exercises, loads and technique is yours and made at your own risk.
Acceptable use
You agree to use the App only for lawful, personal purposes. In particular you may not:
- attempt to access other users' data or bypass the security measures of the App and its backend;
- reverse engineer, copy, resell or commercially exploit the App or its content;
- use automated tools to load the service abnormally, or tamper with the App to bypass the limits of the free plan;
- use the App in breach of applicable law or third-party rights.
Intellectual property
The App, its code, graphics, texts, library and marketplace plans belong to Harem Dev (Andrea) or their respective owners and are protected by copyright law. Harem Dev (Andrea) grants you a personal, non-exclusive, non-transferable and revocable licence to use the App on your device, within these Terms.
The data you enter (plans and sessions) remains yours; you authorise Harem Dev (Andrea) to store and process it to provide the service, as described in the Privacy Policy.
Free plan, ads and TrackFit PRO
The App is free, with ads and a limit on the number of plans you can create or add from the marketplace. With the TrackFit PRO subscription ads are removed and the plan limit does not apply.
Subscription. TrackFit PRO is an automatically renewing subscription, available in two plans with the same benefits: monthly and annual. It is purchased through Google Play on Android or the App Store on iOS (each, a "Store"). The price of each plan, including taxes, is shown on the purchase screen before you confirm. Payment is charged to your Store account (Google Play account or Apple ID) when you confirm the purchase and at each renewal, unless you cancel at least 24 hours before the end of the current period. The monthly plan renews every month and the annual plan every year, at the price shown when you purchased, unless changes are notified as described below.
Managing and cancelling. You can manage or cancel the subscription at any time from Profile → Subscription → Manage subscription or from your Store settings (Google Play, or Settings → Apple ID → Subscriptions on iOS). Cancellation takes effect at the end of the period already paid: until then you keep using TrackFit PRO.
Refunds and withdrawal. Billing, refunds and the right of withdrawal are handled by the Store you purchased from, under its terms; this does not affect the rights the law gives you as a consumer. Harem Dev (Andrea) has no access to your payment details. Purchases are verified through a third-party subscription management provider (RevenueCat), which receives your account identifier to link the subscription to you and restore it on other devices.
After it ends. If the subscription ends and you have more plans than the free limit, your plans stay available and editable, but you will not be able to create or add more until you are back under the limit or return to PRO.
Harem Dev (Andrea) may change the subscription's price and features for the future; price changes will be notified under the Store's rules and, where required, will only take effect with your consent.
Availability of the service
Harem Dev (Andrea) works to keep the App running, but the service is provided “as is”: it does not guarantee it will always be available or free of errors or interruptions. Harem Dev (Andrea) may change, suspend or discontinue features, including for maintenance or for technical or legal reasons.
Suspension and closing of your account
You may stop using the App at any time. To delete your account and the associated data write to info@harem-dev.com: the request will be handled within 30 days, as stated in the Privacy Policy. Any subscription must be cancelled separately on the Store you purchased from: deleting your account does not cancel it.
Harem Dev (Andrea) may suspend or close an account for a serious or repeated breach of these Terms, or to comply with the law, giving you notice where possible.
Limitation of liability
To the extent permitted by law, Harem Dev (Andrea) is not liable for indirect or consequential damages arising from using or being unable to use the App, for injuries or harm to health resulting from the physical activity you perform, or for loss of data due to causes not attributable to Harem Dev (Andrea).
Nothing in these Terms excludes or limits liability for wilful misconduct or gross negligence, nor the rights the law grants you as a consumer that cannot be waived.
Privacy
How your personal data is processed is described in the Privacy Policy.
Changes to the Terms
Harem Dev (Andrea) may update these Terms, for example for new features or changes in law. Material changes will be communicated through the App or by email; if you keep using the App after the notice, the changes are deemed accepted, without prejudice to your right to stop using it and to cancel the subscription. The date of the last update is shown at the top of the document.
Governing law and jurisdiction
These Terms are governed by Italian law. If you are a consumer, the mandatory consumer-protection rules of your country of residence remain applicable and you may bring proceedings before the courts of the place where you live or are domiciled.
For online disputes you may also use the European online dispute resolution platform (ec.europa.eu/consumers/odr).
